By accessing any portion of the COPM website, you agree to the terms and conditions set out below. This is a legally binding contract between you and COPM Inc. Please read it carefully.

1. Use of the Site

The COPM website (thecopm.ca) is a no fee service offered by the authors of the COPM and COPM Inc. The contents of the site are provided for informational and educational purposes only. All information is provided on an “as is” basis without any warranties of any kind. The COPM authors makes no representations and disclaims all expressed and implied warranties and conditions of any kind, including without limitation, representations, warranties or conditions regarding accuracy, timeliness, completeness, non-infringement, merchantability or fitness for any particular purpose. The COPM authors assume no responsibility to the user or any third party for the consequences of any errors or omissions. The subscriber to the COPM website expressly acknowledges that information contained on the site may be provided by independent clubs, associations and organizations and any such information and its content are not the responsibility of The COPM authors. The COPM authors assume no liability for such content or information.

2. Release of the COPM authors

You also agree to release and hold harmless the COPM authors and COPM Inc. from and against any and all liability, claims, damages, actions, and costs, arising out of or in connection with your use, review or reproduction of the COPM website.

3. Limitation of Liability

The COPM authors and COPM Inc. shall not be liable to you and/or any third party for any damages of any kind arising out of or relating to the use of, or reliance upon, the COPM website including, but not limited to, any lost profits, lost opportunities, special, incidental, indirect, consequential or punitive damages, regardless of your advice to the COPM authors to the contrary.

4. Advice

Neither the COPM authors nor any of its officers, directors, employees, or agents makes any recommendation regarding any educational or other matter described within the COPM website.

5. Reproduction of Contents

The contents of the COPM website or related websites may not be used, reproduced, broadcast, published or re-disseminated without the prior written permission of the COPM authors and COPM Inc.

6. Links to other Sites

The COPM website may link users to sites not maintained by the COPM authors and therefore cannot and does not warrant the accuracy, completeness, timeliness, non-infringement, merchantability or fitness for a particular purpose of any information available through these links and disclaims any opinions expressed on such sites.

7. Intellectual Property

The materials located on the COPM website are protected by copyright, trademark and other forms or proprietary rights and are owned or controlled by COPM Inc. and the COPM authors or any other party credited as the provider of the information.

The information you provide to us when you purchase products through our website is owned by you. When you share this information with our site, you grant us a non-exclusive, royalty free, worldwide license to access and use your information to perform the service you requested (such as purchasing a subscription to our learning module).

8. System Integrity

You may not use any device, software or routine to interfere or attempt to interfere with the proper working of the COPM website. You may not take any action, which imposes an unreasonable or disproportionately large load on the COPM website infrastructure.

9. Governing Law

This agreement shall be construed and enforced in accordance with the laws of the Province of Ontario.

10. Disclosures

The information in the COPM website or related websites is offered by the COPM Inc. c/o 155 Park St W, Dundas, ON, Canada, L9H 1X9

11. Entire Agreement

This agreement constitutes the entire agreement between you and the COPM authors and supercedes all other agreements. No other representations or warranties are made, save for those contained within this Agreement.

12. Termination of the COPM Website or Related Websites

The COPM authors reserve the right to terminate or modify, in any manner, the COPM website, and/or any part of any related website any link or linking program at any time for any reason.

13. Statement on Collection of Personal Information and Protection of Privacy

Any information the COPM website collects and retains will be protected and used in compliance with Ontario’s Freedom of Information and Protection of Privacy Act (RSO 1990) and will be disclosed only in accordance with this Act. Information collected through this website is also in compliance with the GDPR from the European Union.

 

Learning Module

By purchasing a Learning Module subscription, you agree to follow these terms and conditions. The subscription starts when the product is paid for and continues for one year from that date.

  • You agree that COPM Inc. owns the copyright and all intellectual property rights for the COPM learning module and all COPM products.
  • Payment of the subscription fee entitles you to use the COPM Learning Module you have purchased for the specified use only. You cannot make the product available to any other person outside of your organization or university program in any way.
  • All COPM products are protected by copyright. You are not allowed to sell or loan copies to anyone else, include the product in any digital format, or include the product as part of a commercial product. You are not allowed to transfer this subscription to anyone else.
  • You are not allowed to modify or adapt the product or remove information about the COPM authors from the product. Reproduction in whole or in part of the COPM product is prohibited.
  • The COPM product is provided to you “as is” and does not include a warranty of any kind. COPM Inc. does not warrant that the product will meet your requirements. COPM Inc. will not be liable for any damages of any kind arising out of use of the product or this license.
 

COPM Manual, Measures, and Translations

By purchasing a COPM Manual, Measures or Translation, you agree to follow these terms and conditions. The license starts when the product is electronically delivered to you and continues unless terminated by COPM Inc.

  • You agree that COPM Inc. owns the copyright and all intellectual property rights for the COPM products.
  • Payment of the license fee entitles you to use the COPM product you have purchased for your personal use only. You cannot make the product available to any other person in any way or allow another person to use it.
  • Purchase of the COPM through this site or other means is solely for individuals, students, academicians, and educational institutions. If for profit companies such as pharmaceutical manufacturers are interested in using the COPM either with employees and/or in clinical trials, please reach out to contact@thecopm.ca for further details and pricing.
  • All COPM products are protected by copyright. You are not allowed to sell or loan copies to anyone else, include the product in any digital format, or include the product as part of a commercial product. You are not allowed to transfer this license to anyone else.

COPM Product Refunds and Returns

COPM does everything it can to ensure that its products are of the highest quality and as described. Accordingly, the COPM anticipates that all sales are final. Nonetheless, from time to time, a customer may wish to return products and receive a refund. As the COPM has a number of ways of selling a products, directly, through its own website, or via a fulfillment firm, a number of different policies apply.

  • 1. Where a product is sold via a fulfillment firm, the policy of that firm applies. At the time of the writing of this policy COPM Inc. uses two such firms and their policies are:

Rittenhouse return policy:

As long as it is in good condition and resalable, the product can be returned for credit. Please include a copy of the original invoice when returning the product.

Login return policy:

All items being returned must be unused, unopened and in their original selling condition. Refunds or exchanges can be made within 30 days of the original invoice date, unless specified as final sale. Please include a copy of the original invoice, contact information, and reason for return. (shipping costs are the responsibility of the sender). All refunds will be issued in the original form of payment.

  • 2. Where a product is purchased directly from COPM Inc., and it is a hard copy item, it can be returned as long as it is unused, unopened and in their original selling condition. Refunds or exchanges can be made within 30 days of the original invoice date, unless specified as final sale. Please include a copy of the original invoice, contact information, and reason for return. (shipping costs are the responsibility of the sender). All refunds will be issued in the original form of payment.
  • 3. Where a product is purchased directly from COPM Inc., and it is an electronic item, no returns are possible. However, COPM Inc. will work with the purchaser to ensure it fulfils all the terms of the purchase. If this is not possible, after due diligence, the cost of the product will be refunded.
